Apple also wins in the “Fortnite” dispute before the US Court of Appeals

The American iPhone manufacturer Apple has also triumphed in the court of appeal in a dispute with the makers of the online game ‘Fortnite’. The judges upheld the lower court’s decision, in which Apple was largely right.

According to the judgment published on Monday, they found an error in the definition of the relevant market – but classified it as unimportant.

The ‘Fortnite’ developer company Epic wanted to avoid the levy of 30 percent of the purchase price that Apple withholds from transactions in its App Store. In 2021, she resorted to a trick: a version of the application was smuggled past the app inspectors, which also allowed users to buy virtual items through Apple.

Apple kicked “Fortnite” from the App Store because of the rule violation. Epic then accused Apple of unfair competition, but lost in court on most counts.

At the same time, however, the court upheld a lower court ruling that Apple should make it easier for app developers to point out purchase options outside the app store. The iPhone group wanted to overturn that. (sda/dpa)
