When Frederick W.* (†91) died in 2020, he left his entire fortune – more than 550,000 francs – to his two living children. He almost completely excluded his granddaughters. The reason: they did not visit him often enough in the hospital when he was admitted three times with lung disease.
In 2015, Frederick W. Junior, the 91-year-old’s third child, died of unknown reasons. He left behind a total of five daughters: Carol G., Angela S., Amanda H., Christine W. and Janet P. They all came away virtually empty-handed, receiving only 500 pounds from Frederick W., which is a little more than 550 francs.
The granddaughters appealed their late grandfather’s decision to the Supreme Court of Great Britain. You would be entitled to approximately one-third of the assets. In addition, Frederick W.’s two surviving children, Aunt Susan and Uncle Terry, influenced their grandfather to exclude the daughters. After Frederick W. Junior died in 2015, the family fell out.
He complained to his daughter
The grandfather lost contact with almost all of his granddaughters; he only maintained a good relationship with his two children, Susan and Terry. That was also the reason why the five never visited the sick Frederick W. in the hospital. But High Court Judge James Brightwell would have none of it: he flatly rejected her claim. “Some believe that if one of the testator’s children dies, the testator is obliged to pass the estate on to the grandchildren. However, the decision not to do so is a precaution that any reasonable testator could take.”
Frederick W. is said to have repeatedly complained to Susan that Frederick W. Junior’s family would never take care of him. “Given the changed circumstances following the death of Frederick W. Junior and the limited contact, it is highly likely that Frederick is disappointed by the five applicants,” the judge continued. Under these circumstances, the judge declared the deceased grandfather’s will valid in 2018. (mgf)
