The National Council will decide in parliament on Wednesday whether young adults who have committed murder after the age of 16 can be detained. The condition for this is that there is a serious risk that the perpetrator will commit such an act again. Nowadays, the Youth Criminal Justice Act does not provide for a pure security measure such as detention to protect third parties.
This could change quickly. Frank Urbaniok (62) has a prominent supporter of the tightening. In the “Tages-Anzeiger” the renowned psychiatrist says he supports the proposal.
Urbaniok wants extra sharpening
If Urbaniok has his way, the law for young offenders would have to be interpreted even more strictly. He demands that detention is also possible in cases of intentional murder, rape or serious bodily harm – although this must be used in a “very restrictive” manner. “There must be a handle for young people who attract attention with extremely serious violence – and who also run a high risk of recidivism,” Urbaniok said in the “Tages-Anzeiger”.
The threshold should not be set too high. Otherwise, there could be cases where detention would be advisable but not possible – “because it was not a murder, but ‘just’ an intentional killing,” the psychiatrist said.
Also SP federal councilor for Adjustment
Last summer, the Council of States voted to make it possible to arrest underage murderers. Andrea Caroni (43, FDP), state councilor of the canton of Appenzell Ausserrhoden, initiated the revision of the law with a motion. The then responsible Minister of Justice, Elisabeth Baume-Schneider (60), also advocated closing the legal loophole in the summer.
As the federal councilor reported, few people would be affected by the change in the law. Between 2010 and 2020, there were twelve teenagers who committed murder. Not all of them were particularly dangerous. Last year, experts estimated that there were only about five to seven cases of juvenile murderers in Switzerland where detention could even be considered.
