The decision in the National Council Committee was taken by a vote of 15 to 10, the parliamentary services announced on Friday. An assault, sexual coercion or rape is committed by anyone who performs a sexual act on a person “without their consent”.

A centre-left alliance has triumphed in the Commission. Shortly after the decision was published, the SP and the Greens reacted with satisfaction. The Green Party wrote that the Legal Commission’s commitment to “Only yes means yes” is a success for all those who have been fighting for modern sexual criminal law for years. The protection of sexual self-determination would finally be enshrined in law.

The SP women spoke of a “milestone in sexual criminal law”. The Commission is demonstrating its stance by supporting the “Yes only means yes” solution demanded by specialized organisations, those affected by violence and the feminist movement in defining rape.

In the summer session of 2022, the Council of States decided on the rejection solution, according to which anyone who carries out such actions “against the will” of a person can be prosecuted.
