Under the new terms and conditions, Swisscom grants the customer the right to adjust prices for inflation, without giving the customer the right to early termination.

The new General Terms and Conditions (GTC) will be effective at Swisscom from next 1 June. They have everything, because it says: “Swisscom has the right to adjust prices for inflation without giving the customer extraordinary or premature termination.”

Swisscom recently provided information on this matter via SMS, letter or e-mail, as it was originally reported as “20 minutes”. Swisscom grants itself the right to increase the subscription price based on increases in the national consumer price index (LIK). The LIK measures the price evolution of goods and services important to the household and is calculated monthly by the Federal Statistical Office.

Swisscom does not adjust their prices for every move of the LIK. However, it gives itself the right to adjust them for inflation, without customer consent. This snippet in the general terms and conditions was not established simply as a preventative measure – it should be expected that subscriptions will soon become more expensive.

No joy in consumer protection

Consumer protection opposes this proposal. In this way, Swisscom completely transfers the risk of inflation to customers, writes consumer protection. Theoretically, inflation can be fully passed on to customers. In addition, consumer advocate Sara Stalder (56) criticizes the fact that prices can be increased before customers cancel early. The fact that price increases are based on LIK is also a problem for him: if Swisscom increases prices, the LIK will go up too. And if the LIK goes up, Swisscom could raise prices too. An inflation spiral is feared.

Theoretically, it is possible to reject the new terms and conditions. Then you have the right to early termination. Swisscom must be notified of this refusal by 31 May 2023 at the latest.

But what will happen next? Going to the competition only creates so-called security. Sunrise and Salt also reserve the right, on their terms and conditions, to increase subscription prices due to inflation.

A Salt spokesperson told Tages-Anzeiger that the company has no intention of enforcing this clause. Sunrise can now adjust subscription prices once a year at the beginning of the calendar year.
