Before EU court: Lego wins dispute over toy building blocks

It is a flat stone with four nails in the middle, which Lego protected in 2010. Lego is managing a legal dispute with German company Delta Sport Handelskontor, which produces toys, among other things. Delta applied to the European Union Intellectual Property Office (EUIPO) in 2019 to deprotect the Lego brick.

The office accepted the request: All properties of the stone are determined solely by its technical function, meaning that the figures can be reassembled and disassembled. However, the EU court overturned this decision in 2021. EUIPO had to decide again and this time rejected Delta Sport’s application. The German company filed a lawsuit against it but was unsuccessful. The EU court rejected the case.

Therefore, such a design can only be declared invalid if all its features are excluded from the scope of protection. However, according to the judges, this was not the case here. An exception for protecting modular systems also does not apply. For this to happen, the stone must meet certain requirements, such as novelty and uniqueness. The court said Delta Sport had not proven this. The decision can still be appealed to the European Court of Justice (ECJ). (SDA)
