This was a bad surprise for Ried-Brig VS’s Fabian Molinari (50). Suddenly he received a payment order from the Groupe Mutuel insurance company. It was stated that this was the last chance to pay the bill for the legal protection insurance he had recently taken out.

The problem is that Molinari never took out such insurance. He proposes a law against the debt collection claim and finds out that his signature on the insurance contract is forged. “It’s amazing how brave some people are,” he says angrily.

A seemingly non-binding conversation

At the beginning of the year, Molinari came across an ad for legal protection insurance on social media. He is interested and fills out an online form with his details. Two months later, an insurance broker gets in touch. “When the woman called, I explained to her that I was no longer interested,” Molinari said in his interview with Blick. She doesn’t even remember the name of the woman who spoke French.

The nasty surprise came a few weeks later when Groupe Mutuel’s legal protection insurance bills suddenly landed in the letterbox. Molinari ignores this. “I didn’t sign anything.”

Reminders follow, but Molinari does not respond to them either. However, when sanctions come, he feels compelled to take action. Offers legal advice. “Even though I explained that I had not signed any contract, the insurance company insisted that I pay,” Molinari said.

Where does the signature come from?

The butcher master does not want to allow this. He calls the insurance company and they explain that he has legal protection insurance for him. Molinari says: “This can’t be true.” Came to the Groupe Mutuel branch in Brig-Glis VS and was amazed. “There was a relevant policy, but the signature was not mine.” Molinari’s assumption is that the broker signed the contract himself to collect commission from the insurance company!

He shows his ID and explains that he didn’t sign anything, so the contract is invalid. “That was accepted and I thought that was the end of the matter.” He decided not to press charges against the broker and wanted to file the matter. “In my view it is up to Groupe Mutuel to take action against this person.”

However, for Molinari, the problem is not solved yet. Even though the insurance company knows that the butcher’s signature is forged, they send him another invoice. Just a few days ago Molinari received confirmation that the matter had finally been resolved. “This incident shows how careful you should be about what you click on the internet,” Molinari warns.

Insurance says: “Misunderstanding”

This situation has no consequences for the broker. Mutuel media spokesperson Serkan Işık explains Blick’s question as follows: “In this case, the suspicion of signature forgery has not been confirmed. We have the digital signature of the relevant person created during the telephone sales call and simultaneous digital shopping.”

The insurance company therefore assumes that this was a misunderstanding and that Fabian Molinari was not aware that he had signed a contract with this digital signature. Therefore the contract was terminated.

This attitude of the insurance company leaves Fabian Molinari speechless. He never used a digital signature. “Someone signed for me, either analog or digital,” he says. “And that wasn’t legal!”
