Naked landlord in the garden of a building is not rent-free. The high district court in Frankfurt am Main (Germany) announced on Wednesday that the homeowner’s bathing in the nude sun will not affect the usability of the building. The court ruled that this was not an unacceptable, deliberately immoral effect on the property and thus largely upheld the landlord’s complaint against the rent reduction.
The claimant rented an office floor in a building in Frankfurt Westend. The building was also used by the plaintiff for living – among other things. Those who used the office floor reduced the rent for various reasons after about a year. The landlord now wants the money in court.
Discussion about the bathrobe
The office tenants’ appeal to the District Supreme Court was unsuccessful. Situations that offend another’s aesthetic feelings do not, in principle, lead to a defensive claim, unless they are specifically directed at the other person. Where the landlord is lying naked on the chaise longue can only be seen from the office if you lean out of the window.
The office tenants’ claim that the landlord had previously walked naked from the stairwell to the courtyard could not be substantiated. The man convincingly said that he always wears a bathrobe, and that he only takes it off right in front of his chaise lounge. However, the court agreed with the office tenants that they were allowed to reduce the rent by 15 percent for three months due to a large construction site in the neighborhood. (AFP)
