TSXG cancels the approval for the construction of the Bustelo wind farm

The Xustiza de Galicia Supreme Court annulled the previous administrative and construction approval given by the Xunta to Greenalia for Bustelo wind power plant, in Coristanc and Carballo. The TSXG supported the appeal of the Association for the Ecological Defense of Galicia (Adega) against the June 2021 decision.

The judges consider it proven that there was an unjustified fragmentation of the project. They emphasize that, just as in the verdict that annulled the construction permit for the Campelo building, it was openly admitted “that fragmentation of the environmental impact assessment of the three wind farm projects -Campelo, Monte Toural and Bustelo- which in reality were not autonomous, but integrated and dependent on each other, sharing structures and connections». Therefore, it is concluded that the ordinary environmental impact assessment should have been unique.

In addition, in the third section of the litigation-administrative matter, it is recalled that the Law on Environmental Impact Assessment mandates that sectoral reports must be obtained before the public information procedure. Therefore, it should be noted that when the project was submitted to this last process, not all sector reports had been received yet. “The result of this is that those who have already submitted a request or those who have not yet done so within the given period could not fully exercise their right to effective participation and with full knowledge of all the options offered,” he concludes.

The sentence was announced last Friday, but the courtroom discovered an obvious, essential error, because instead of “appreciation” the decision read “reject”.

The budget for the realization of Bustelo Park is 35 million euros, of which 7 have already been invested. Out of 45 megawatts, it made it impossible to mobilize 175 jobs.
