The plans for a “self-determination law” planned in Germany to make it easier to change the gender input and first name become more concrete with a draft.

“With the Self-Determination Law, we are introducing a simple and uniform regulation for changing the gender entry,” German Family Affairs Minister Lisa Paus (Greens) said in a statement. She published the newspaper on Tuesday together with Justice Minister Marco Buschmann (FDP). The associations can now submit a statement to the ministries at the end of May.

The parties of the “traffic light” coalition (SPD/FDP/Greens) had agreed on the project in their coalition agreement. According to the plans, everyone in Germany should be able to determine and change their gender and first name themselves in a simple procedure at the registry office. According to the Ministry of Family Affairs and Justice, the law is aimed at transgender, intersex and non-binary people.

The Lesbian and Gay Association in Germany (LSVD) welcomed the publication of the draft. “Since the key issues paper was presented in June 2022, those affected and their interest groups have long been waiting for this next step, which has been postponed several times,” said Mara Geri of the Federal Board of Directors. The union now wants to analyze the regulations in detail.

According to the ministries, “trans” includes people who do not or only identify with the sex they were assigned at birth. “Inter” means having congenital physical characteristics “that cannot be clearly classified as (only) male or (only) female by medical standards”. “Non-binary” is defined as a self-identification for people who do not identify as male or female.
