Father wants to ban sexes in court – Berlin court rejects application

Berlin’s administrative court has rejected the urgent submission of a father of two high school students against the use of gender-neutral language at school.

Against the background of the state’s education mandate, it was unlikely that the school’s board of trustees would have to intervene, the court ruled Monday. In a Liberal Democratic community, the school can also be open to a wide range of opinions and views.

The court clarified that the school management had given teachers the freedom to use gender in the classroom, while at the same time pointing out that spelling rules had to be followed. The use of gender-neutral language in teaching materials does not go beyond the space offered by the framework curricula.

Gender-neutral communication with parents and students is also not objectionable, “since this remains sufficiently understandable given the broad social discussion, even when special characters are used”.

The court is convinced that the principle of political neutrality is not violated in the school service either. No political expression goes hand-in-hand with gendering, mainly because it also allows political attribution without it. The father had also shown no unreasonable disadvantages for his children.
