Son demanded compensation for pain and suffering after his father’s corona vaccination

The court said Thursday evening that it had not said anything about the father’s post-vaccination health problems — including swelling or tension in the injection site area. The then 87-year-old father died in the meantime – eight months after his last vaccination. His son is heir.

Father was insufficiently informed

The father was vaccinated against Corona by a GP in June and July 2021 and in January 2022. He died in September 2022. The son stated that his father was not sufficiently informed before the vaccinations. Therefore, his consent is invalid. As heir, he is entitled to a compensation of 7,500 euros per vaccination of the father.

However, the court rejected this. It is irrelevant how exactly the father was informed before the vaccination, it argued. Even in the absence of effective consent, the needle stick and vaccination are minor inconveniences that have had no lasting impact on the patient’s well-being. The son can still appeal against the decision at the Higher Regional Court in Stuttgart.
