Since there is a high risk that the convicted person will subsequently become a criminal again, she must then be kept under supervision for another three years, the competent judge at the High Court in Edinburgh said on Tuesday. 31-year-old Isla B.*, who raped a woman in 2016 and 2019, vehemently denied all allegations, claiming to the end that the sex was consensual.
Gender reassignment took place after the crimes were committed. “They see themselves as victims in this situation, but they are not,” the judge told the convict. “Your own vulnerability does not excuse what you did to these two women.”

The Isla B. case had caused quite a stir in Scotland and beyond, because the trans woman was initially held in a women’s prison during her pre-trial detention despite the rape. After an official government investigation, she was transferred to the men’s ward of another prison.
