A US court has ruled that Donald Trump does not enjoy presidential immunity. The former US president is one step closer to an unprecedented criminal trial.

Donald Trump could be prosecuted over allegations of election fraud in 2020, a US court has ruled.

“For the purposes of this criminal case, former President Trump has become Citizen Trump, with all the defenses that any other defendant has. But the executive immunity that protected him during his term as president no longer protects him from this prosecution.”

Trump has been invoking presidential immunity for years while fighting several lawsuits. The former president is expected to appeal the ruling, meaning the case could ultimately go to the Supreme Court, where conservatives have a 6-3 majority.

Serious accusations against Trump

In his indictment, US special counsel Jack Smith accuses 77-year-old Trump of trying to overturn the results of the 2020 presidential election. According to the indictment, he allegedly spread false claims about election fraud and pressured Justice Department officials and his then-Vice President Mike Pence.

Trump then regularly tried to avoid a trial by claiming to be politically immune.
