The amount is small, but the loss of trust is enormous. That is why the boss of a youth hostel in Duisburg (D) decided to fire receptionist Florian M.* (27) – without prior notice. He had charged his electric car, a Golf Hybrid, at work. The loss for the hostel: only 40 cents!
Florian M. successfully defended himself against the termination. First before the Duisburg Labor Court in March and now before the State Labor Court, as “Bild” reports.
“I wanted to make sure I went home with it.”
During the trial, the 27-year-old explained that there was an emergency that day in January. His Golf suddenly barely had a battery anymore. That’s why he charged the car at work.
“I just wanted to make sure I came home with it,” Florian M. said during the trial.
Even charging your mobile phone is not allowed
His boss told the court that the employee had tapped electricity at work more than once.
He was aware that the damage was minor, but trust had been seriously damaged. That’s why he fired Florian M. You’re not even allowed to charge your mobile phone, the boss continued. This is also stated in the house rules.
Compensation for Florian M.
But the judges disagreed, because the house rules only apply to guests. But Florian M. was an employee. Then came the verdict: the termination was not legal.
Florian M. receives a severance payment of 8,000 euros. But he still doesn’t want to work at the youth hostel anymore. It was also clear to the jurors that too much had happened. The employment relationship was therefore not resumed. (ymh)
