Children can be real noise pests. Screamers often get irritated looks on public transport, on planes or in restaurants. But for the neighbors of a Viennese woman, the noise from the children at home went too far: they called the court.
As “heute.at” reports, a woman (27) in Vienna is about to be forced to move with her four- and six-year-old sons. The reason: the two children would have occupied the entire house with their noise.
An elderly couple filed a lawsuit
The court in Florisdorf ruled in its judgment that the mother had to leave her apartment due to noise pollution.
One couple in particular, aged 75 and 78, was particularly upset by the children’s activities. The strange thing, however, is that the two do not live in the same building as the children, but near the source of the noise.
The couple complained not only about the noise, but also that it had health consequences. The two often suffered from palpitations and stomach aches.
The couple therefore filed a lawsuit in October 2022. As stated in the lawsuit, the two children allegedly attracted attention 24 hours a day by playing football and making unbearable noise. In addition, the mother often threatened neighbors. She denies the accusations.
Clearance period of 14 days
“It is completely normal for children this age to be loud and make noise. “You can’t be silent 24 hours a day,” she told “heute.at”. However, the court concluded that the mother had not changed her behavior or that of her children even after filing the lawsuit. The bitter consequence: she has to leave her apartment within fourteen days and also has to pay approximately 5,000 francs in legal costs.
“The ruling is an absolute shame, how can you act like this against two small children? Why can’t my sons grow up normally and be children?” The court decision has serious consequences for her and her sons.
“I have neither the opportunity to get a new apartment nor to go anywhere else with my children,” the mother of two explains her dilemma. The latter would be completely uprooted from their daily lives and would have to change schools and kindergartens. “And also at Christmas.” (ced)
