His government has introduced the “toughest legislation on illegal migration” yet, Sunak said at a brief press conference on Thursday.
The now planned legislation would block all the reasons that previously prevented migrants from flying to Rwanda.
The British government wants to immediately deport asylum seekers who enter the country illegally, regardless of their origin, to Rwanda. They would have to apply for asylum in the east African country, but would not be allowed to return to Britain.
The High Court in London also stopped the project on the grounds of constitutional deficiencies in Rwanda. The government wants to circumvent the concerns with a new law. The country must be declared a safe third country. Sunak also wants to declare a British human rights law inapplicable.
“We will get flights in the air,” Sunak said. Indirectly, he threatened to withdraw from the European Convention on Human Rights if in doubt. “I will not allow a foreign court to block these flights,” Sunak said. If the court in Strasbourg intervenes, it will do what is necessary to make these flights possible.
For some hardliners in his Conservative Party, the plans do not go far enough. Former Home Affairs Minister Suella Braverman, for example, is in favor of withdrawing from the European Convention on Human Rights to avoid lawsuits in international courts. On Wednesday, the foreign secretary responsible for migration, Robert Jenrick, who is effectively considered Sunak’s confidante, also resigned. Sunak argued that if the government had gone further it would have jeopardized the entire deal with Rwanda.
