The dream of driving a luxury car became a very expensive nightmare for Thomas G.* (32). In October 2018, the German wanted to redeem a gift voucher for a trip in the luxurious Lamborghini that he had received from his wife.

With the voucher he rented a Lamborghini Huracán LP 580 worth almost CHF 250,000 from a car dealership in Jüterbog (D).

As reported by “Bild”, Thomas G. was home first for a photo shoot. On the way back it was already dark and raining. Thomas G. overtook two cars, lost control of the 580 hp Lambo and crashed into two trees: total loss.

His passenger slightly injured his hand, Thomas G. was unharmed. After the accident, the two occupants attacked each other: the passenger accused Thomas G. of having accelerated to 170 km/h. Conversely, the accident driver claims that his co-driver engaged the Lambo’s sport mode and disabled the assistance systems.

Insurance does not pay

But then the chaos really started. The insurance of the Lambo did not want to pay the damage of more than 135,000 euros. The dealer then sued the 32-year-old German. The accusation: Thomas G. would have been grossly negligent. “He was demonstrably much too fast,” plaintiff told “BILD”.

Now the Higher Regional Court of Dresden has to hear the case. The judge made it clear on Wednesday: “Gross negligence could not be established so far. You could still file an accident report, but we clearly see the risk of litigation with the plaintiff.”

The district court of Leipzig had already rejected the claim for damages at first instance. Thomas G. was only fined for causing bodily harm through negligence. The Senate of the Higher Regional Court proposes that the driver of the accident pay the dealer 5,000 euros. But then everything must be eaten.

If no agreement is reached, the verdict will be announced on August 2. (jl)
