German court renders its verdict: Diesel plaintiffs are entitled to compensation

Accordingly, car buyers who have an illegal shut-off device called a thermal window installed in their diesel vehicle are entitled to compensation if the automaker acts negligently. Thermal windows control exhaust emissions based on outside temperature.

Until now, from BGH’s point of view, a thermal window was not deliberately and deliberately installed cheat software by manufacturers to cheat actual pollutant emissions, and therefore there was no reason for damage.

A decision by the European Court of Justice (ECJ) in March this year forced the Diesel Senate to reconsider. Drivers may now be entitled to financial compensation if they buy a car with thermal glass integrated into the engine without their knowledge. Car owners sued Audi, Mercedes-Benz and Volkswagen.

Thermal glasses can be found in millions of diesel cars and cover different temperature ranges where they throttle or even shut off the circulation of exhaust gases. The Federal Motor Transport Authority (KBA) had approved the technology. Car manufacturers have always stated that these functions serve to protect the engine. Critics saw this as a consumer deception about the actual emission of pollutants.
