The Ministry of State opposes the request of the football player’s defense because it believes that he can flee to avoid justice

Barcelona’s prosecutor’s office opposed the temporary release of the former Barca player Daniel Alvesas requested by his defense last week, considering that there is a danger that the footballer will try to escape from justice.

According to sources from the Public Prosecutor’s Office, the prosecutor in this case submitted a report to the Barcelona Investigative Court number 15 in which she claims that the circumstances have not changed compared to January 20, when Alves entered prison accused of raping a young woman in the Sutton nightclub , so the risk of escape remains.

After obtaining the views of the partiesthe investigating judge must now decide whether to agree to the request of Alves’ defense and leave him on temporary releasewith such precautions as he deems fit, a decision which may be appealed before the Court of Barcelona.

Last week, Alves’ defense team asked the judge investigating him for the alleged violation to release him on temporary bail. if necessary with bailbased on the expertise of footage from the night club’s security cameras that he claims exonerate him.

In the filing, the lawyers of footballers Cristóbal Martell and Arnau Xumetre claim that these pictures would show that the accused and the victim flirted before the fact, danced and drank together, and that she voluntarily entered the bathroom after Alves. .

More precisely, the lawyers claim that a 200-page expert report that analyzes images frame by framerefutes the “microcosm of panic and terror” reported by the victim and points out that they spent twenty minutes together before going to the bathroom “They were characteristic of sexual flirtation.”

They also claim that the images were taken by private security cameras contradicts the testimony of two friends who was accompanied by the complainant, who explained to the judge that the football player approached them with obvious sexual intent to make them feel uncomfortable.

Alves made his request for release after appearing before the investigating judge for the second time, this time at his own request, at an appearance on April 17.

The Brazilian soccer player claimed before the judge that the sex with the prosecutor was consensual and that he lied in his first statement to hide his infidelity from his wife.

On February 21, the court in Barcelona already rejected the same arguments put forward by the defense in its appeal – based on the roots and on the security camera footage – when it decided to keep the footballer in preventive detention, appreciating the “high” risk of escape and considering that the evidence who charge him with “heavy” and “miscellaneous”.
