Today, for the first time after 15 years, a conditional release can be examined. The Federal Council states that the new regulation will make a better distinction between life imprisonment and 20 years imprisonment. In this case, someone will be released after 13 years at the earliest.

Detention bottleneck

The Federal Council also wants to regulate the relationship between life imprisonment and detention. Today it is possible to sentence someone to life imprisonment and keep them in custody at the same time. In practice, however, a transfer in custody is not possible at all – because parole from a life sentence is only an option if it can be expected that someone will prove themselves in freedom.

The current situation is shocking, the Federal Council wrote in its communiqué: Rehabilitation is central to the penal system. Detention, on the other hand, is mainly about protecting the population against dangerous persons.

According to the proposed amendment to the Penal Code, detention rules should in future be applied once convicts have served 26 years in prison.

No more extraordinary layoffs

A third legislative amendment is also part of the consultation: the Bundesrat wants to abolish the possibility of an extraordinary conditional release for all prison sentences. In practice, this provision has no meaning anyway, he motivated the plan.
