New twist in the Garcia case law – law student and GLP member Benjamin Gautschi (30) files a complaint in federal court. He is convinced that the party change by Isabel Garcia (59), councilor of the canton of Zurich, was not legal, the “Tamedia” newspapers write.
Garcia switched from the GLP to the competitive FDP shortly after her election to the cantonal council in February. Left-wing politicians in particular, but also voters felt offended by the change ten days after the election.
Repeal of the decision of the cantonal council
With his appeal to federal court, Gautschi wants to reverse the decision of the cantonal council, which confirmed Garcia in office by a vote of 107 to 52. The cantonal council declared the election valid without having dealt with its legality. Gautschi finds this “very annoying”.
He’s asking federal court to issue a super-preliminary injunction for Garcia. That would exclude her from voting in the cantonal council until further notice – at least until the matter is clarified.
Climate Alliance and judge elections
When Garcia switched to the FDP, the so-called climate alliance consisting of SP, GLP, Groenen, EVP and AL lost the majority in the cantonal council. This is against the will of the people.
