Report fires government councilor Dittli from Vaud

Lawyer and professor of tax law Yves Noël has drawn up legal advice on the tax residence of Valérie Dittli.

She therefore decided to hire an independent expert to investigate her case.

Yves Noël took over this task. The lawyer and professor at the University of Lausanne (UNIL) has prepared a legal opinion classified as “confidential” on Dittli’s tax residence from 2017 to 2022.

Your young age is crucial

As he writes in the report, Dittli’s age is decisive. For young people under the age of 30, the place of employment is not yet relevant for determining tax residence. It is only considered a helmsman’s place if someone has a special connection with that place. Otherwise, the family home is decisive.

In the case of Dittli, Noël sees no problem in the fact that she was enrolled at home during her dissertation and not in Lausanne.

However, the expert admits that the demand could have arisen from 2021. With the “official entry of the middle politician into politics” and her candidacy for the office of the city council of the Vaud capital. “But at the beginning of this year, Valérie Dittli first announced her main residence in Lausanne,” he notes.

Since she was neither elected to the Lausanne city council nor to the city council in March 2021 and started a legal internship in Bern on April 1, she then re-registered in the canton of Zug.

The lawyer states that the politician “aligned the beginning of her active career with German-speaking Switzerland”. A project that “would only have changed if she had been elected to the Lausanne city council”.

At the time, no one could have imagined what was about to happen – The appointment of Dittli and her election as a member of the State Council in Lausanne came as a total surprise. “The return of the main residence to Zug at the end of the election campaign for the city council thus fulfilled the legal requirements,” says Noël.

How did Valérie Dittli react to this report? Does she now feel free of any suspicion? Does she know Yves Noël personally? Dittli declined to respond to Blick’s request.

The Vaud government itself announced a legal clarification after the allegations became known. It remains to be seen whether the results of this independent report will match those of the Lausanne law professor.
