The Federal Criminal Court has rejected the complaint of a former director of Postauto. The man criticized the appointment of two members of the federal tax authorities to lead the investigation into the transport company. In 2021, these officers will replace the two originally appointed case officers.
Emanuel Lauber and Sascha Pollace were selected by the Federal Police (Fedpol) in September 2021 to take over the investigations that have been ongoing since February 2018. An originally appointed former federal judge and a cantonal coroner were replaced because there is no legal basis for appointing outsiders.
Fedpol did the right thing
The complainant believes that such a legal basis is also lacking for investigating officers of the federal tax administration. He complained that the Federal Council’s decision to transfer the investigation to Fedpol did not allow the task to be transferred to tax officials.
In a decision published on Wednesday, the Complaints Chamber of the Federal Criminal Court rejected this complaint from the board member. She notes that the person concerned was not involved in the investigations of the two tax authorities.
