The VBS employee, who is approaching 50, also mentioned the increased retirement age for professional soldiers as part of his claim. This was 58 years until 2013, then it rose to 60 years and in 2019 even to 65 years.

The professional military viewed early retirement as compensation for overtime. But with the higher retirement age, this compensation no longer applies – which is why he insisted on payment of overtime. The VBS countered that there were other, including financial, compensations for the higher retirement age.

Insufficient evidence

It was also controversial whether and how much overtime there actually was. The complainant “worked primarily in the office and during office hours” and reported fewer than 45 hours per week into the system, the DDPS argued. The career officer countered that the time tracking tool was only for project-related work. Since his entire working time cannot be proven on a one-to-one basis, it must be estimated.

The Federal Administrative Court did not listen to the VBS employee’s claim and rejected his claim in a ruling in mid-February. The person concerned could not provide sufficient evidence of his alleged overtime. He also subsequently adjusted the entries in his Outlook calendar.
