The uniform protection status should apply to everyone who needs protection. The application of protection status S after the Russian invasion of Ukraine has exposed the legal inequality regarding the status of provisional admission, the SFH announced on Friday.
Nevertheless, protection status S has proven itself with regard to the integration of Ukrainian refugees in Switzerland: Switzerland has easily been able to accept numerous people from Ukraine in need of protection without overburdening the asylum procedure.
From the SFH’s point of view, status S should therefore be continued for the time being, as decided by the Federal Council in November. The number of applications remained very high last year at approximately 20,000. After two years of war, any prospect of peace in the near future seems unlikely, the SFH said.
Given the hostilities and continued rocket fire across the country, the security situation in Ukraine remains volatile. The SFH therefore rejects a restriction of protection status S and incentives to increase the return rate of Ukrainians, as demanded by the Financial Commission of the Council of States (FK-S).
According to the organization, the status may only be revoked if the war in Ukraine comes to an end within the framework of a peace agreement and the security situation on the ground is guaranteed by independent international organizations.
The SFH therefore welcomes the fact that the federal government, in consultation with the cantons, has already prepared a concept at an early stage on how a future abolition of the S status should proceed. The withdrawal should also take place in coordination with the European Union (EU), the report said. (SDA)
