Less than 100 days into office, Justice Minister Beat Jans (59) appears before the media in Ticino – and speaks bluntly: “Anyone who thinks that left-wing politics means turning a blind eye to problems is wrong,” he says . which meant that expectations of him as an SP councilor were high.

“Asylum centers are not emergency sleeping places,” the Basel resident continued. For example, it would not work if migrants were to knock on the door of federal asylum centers on Friday evening and disappear again early Monday morning before authorities started taking fingerprints.

Jans makes it clear that these overnight guests mainly appear when a major event is taking place near the center. He explains what he has probably been told several times by security authorities: many of these migrants only show up to take advantage of the rush of pickpockets.

The fact that a leftist is so open about the problems in the asylum system will be a topic of discussion for the SP. This takes the wind out of the SVP’s sails. She can only demand that the beautiful words are followed by actions. The responsible State Secretariat for Migration (SEM) already knows for sure: “A different film is now being shown.” The new Minister of Asylum listens and acts as the migration authorities want.

Not all measures that Jans presents are his ideas. Predecessor Elisabeth Baume-Schneider (60) had already put a few things on track. For example, the 24-hour accelerated procedure for hopeless applications. But Jans has decided to introduce this throughout Switzerland.

Reduce current obligations

If these requests are processed more quickly, capacity will be created for migrants who are actually in mortal danger. And it must free up resources to process the 15,000 asylum applications that have piled up.

The ultimate goal of the 24-hour procedure is to prevent you from receiving any more hopeless applications. Because this small number of asylum seekers, who often know that they cannot stay, is responsible for the majority of the problems. They receive the most complaints. They cause a lot of work for the police, they cause most of the problems in asylum seeker centers and all other asylum seekers suffer.

That is why Jans wants to tighten the screws when it comes to problem cases. The Minister of Justice makes it clear that all criminal and immigration law measures “including administrative detention or deportation detention” must be exhausted to prevent these people from committing new crimes. Here he holds the cantons responsible.

A new chapter?

He is also exploring the possibility of limiting access to asylum centers to Monday to Friday and requiring written reasons for asylum applications with a very low chance of success. If successful, Switzerland will open a completely new chapter in the asylum system.

There is a noticeable sense of optimism. Jans also wants to get the cantons back on board. Because former Minister of Justice Karin Keller-Sutter (60) assigned more asylum seekers to them faster than agreed in 2022 and therefore allocated more asylum seekers, they were permanently angry. Her successor Baume-Schneider was also not always lucky. The desire to place asylum containers in reserve was poorly received.

“There’s more to come”

Jans knows from his own experience as a former district president of Basel what he is talking about and where the cantons reach their borders: there is a large federal asylum center in the vicinity of his city canton – with all the problems that entails.

And so we hear from the department that the new boss is really concerned about effective measures to tackle the problems in the asylum system. And that he still has many ideas. “He should also have something to say during his 100 days in office speech in early April.”
