In February 2022, Switzerland adopted the “Yes to the protection of children and young people from tobacco advertising” initiative.

The decision is and remains controversial. The National Council’s Health Committee still does not want to ban tobacco advertising in the inside pages of newspapers and adult magazines. In doing so, she opposes the Council of States, which wants to strictly implement the initiative for a ban on tobacco advertising on this point.

In concrete terms, according to the National Council Committee, tobacco advertising should continue to be allowed in newspapers and magazines sold through subscriptions and whose readership consists of at least 95 percent adults. This weakening failed in the Council of States.

Mobile sales should also not be banned

The sale of tobacco products by mobile sales staff in places accessible to the public and accessible to minors should also not be prohibited. On this point, the National Council Committee is on the same page as its sister committee.

Unlike the Council of States, it does not want to allow direct, personal sales promotion of cigars and cigarillos. Such actions should only be allowed in places to which minors do not have access.

The initiative’s sponsoring association criticized these decisions as “a huge disregard for the will of the people.” When voting in February 2022, the people and states decided that tobacco advertising, e-cigarette advertising and other nicotine products should not reach children and young people.

The SP accuses citizens of giving in to the tobacco lobby – despite the clear support of the electorate for the ‘Children without Tobacco’ initiative.

The proposal will be discussed in the spring session. The intention is for the new regulations to come into effect from 2026. (SDA)
