Claudio talks and talks. He repeats the instructions he gives his Tiktok viewers so often in foreign language that they only want one thing: to get away from his channel. And yet you stick around and see if anyone can push nine teeth onto a plastic crocodile without closing its mouth. Whoever succeeds wins the jackpot – probably 73,000 francs today.

The live broadcast is a joint effort of a young Swiss couple: 30-year-old Elena, who calls herself ‘Crypt0blondie’, checks on her mobile phone which user can then announce which teeth need to be pressed, while her 31-year-old husband Claudio talks and acts about the crocodile. “You know, you can only participate if you send us the diamond gift,” he says.

Jackpot can only be won by betting money

Diamonds are a virtual currency on Tiktok. This allows users to express their sympathy for the influencers. If an influencer receives 1000 diamonds, they can cash out $25.

Users must purchase the diamonds with real money. How much a diamond costs depends on the popularity of the influencer, usually a few francs. In other words, to participate in the jackpot competition, viewers have to pay something. This could become a problem for the two influencers Elena and Claudio, but also for other users from Switzerland who organize such competitions.

A license is required for gambling

Money games are subject to strict rules in Switzerland. Anyone who wants to offer them must obtain permission from the authorities. However, according to the Intercantonal Gaming Authority (Gespa), the two people behind the username Crypt0blondie do not have such a license. Because only companies can apply for one. “Natural persons cannot obtain permits or concessions to practice gambling,” says Patrik Eichenberger, deputy director of Gespa.

According to Eichenberger, a gambling game takes place whenever a cash bet promises a jackpot or other monetary benefit – including items such as a luxury watch or electronic items, which are also raffled through Tiktok.

Apparently not all viewers are completely comfortable with the matter. During the live broadcasts, in the comments they repeatedly express their concerns about whether profits will ever be paid out – which Elena clarifies with sharp words: “You come to our channel and complain – then just go to another profile. We need haters here.”

Another user went even further in mid-December: he tagged the Aargau cantonal police, which is very active on the platform. Shortly afterwards, the reporter’s account became inactive. “We are aware of the Crypt0blondie case,” said Vanessa Rumpold, media spokesperson at Kapo Aargau. The two people have been informed of the suspected illegal gambling of the two people and make it clear who is responsible for the matter.

Tiktoker couple not answering questions

The observer wanted to know from the two Tiktokers whether they were aware that their activities were not entirely harmless. How many times has the jackpot been won? Was it ever paid off? And how much does the couple earn from the game? But all attempts to contact him through Tiktok, Claudio’s lawyer and his mother were unsuccessful. There were no answers to the questions. Instead, they blocked the observer on Tiktok – and happily carry on.

It is still unclear whether the couple actually committed a crime; the presumption of innocence applies. If the investigating authority concludes that it is an illegal game of chance, the two could face prison sentences of up to three years or a fine. It is possible that the Lamborghini SUV that Claudio recently bought for his Elena will disappear from the couple’s fleet again.
