Federal Administrative Court approves complaint: Switzerland must grant asylum to Afghan women

A self-determined life for women and girls in Afghanistan is not possible under the current regime, concludes the verdict published by “NZZ am Sonntag”. This discrimination is an important motive for persecution under refugee law, the judgment continues.

In September 2022, the SEM rejected the two women’s asylum applications and ordered their removal from Switzerland. The Afghan women filed a complaint against this.

However, in July this year, the SEM changed its practice and, on the recommendation of the European Asylum Agency, decided to grant asylum as a rule to women from Afghanistan. After two motions from the SVP, this decision will be discussed in an extraordinary session in parliament next Tuesday and Wednesday.
