Ignazio Cassis had supported Switzerland by agreeing to a controversial UN resolution questioning Israel’s right to defense. And now he wants to declare Hamas illegal through an emergency procedure. With Hü and Hott, a boss may be able to run his own Chrömli factory, but a member of the government cannot run his department. Federal councilors need a clear line. The law and the constitution form the framework.

Since Corona, the Federal Council apparently considers the emergency law as the norm. When tackling the pandemic, the question was asked whether it was right at the time for the entire Federal Council to resort to the emergency law. They had to acknowledge that it could hardly be otherwise and agreed: emergency legislation should be avoided as much as possible. Yet the government immediately intervened again: placing Axpo under the rescue package and saving Credit Suisse through UBS.

Even if the Federal Council does not currently take emergency legal measures, Cassis would like to go very far and impose an emergency law. But a new law may only be implemented as an emergency procedure if it cannot be postponed. When it comes to the Hamas ban, it doesn’t matter whether it comes a few months earlier or later.

If Cassis still wants to leave the regular legislative path and let the people out, it shows a questionable understanding of democracy – from a member of the government, mind you!
