Dozens of illegal chalets were built in Verbier in 2015 and 2016. They were approved by the municipality of Bagnes, even though they violated the cantonal building regulations, the Lex Koller or the law on the second home. (symbol image)

The subdistrict court of Valais confirmed the verdict at first instance, but increased the sentences for the two defendants. The former mayor is punished with a suspended fine of 50 daily rates. The former municipal secretary will receive a conditional fine of 30 daily rates, the subdistrict court announced on Thursday. When asked, the court did not want to provide information about the level of the daily rates linked to the wages of the convicts.

The municipality of Bagnes (now Val de Bagnes), which also includes the municipality of Verbier, terminated the employment relationship with the employee on February 25, 2016. On May 4, she justified the dismissal with an internal reorganization of the administration.

The subdistrict court convicted the two civil servants for forgery of documents and falsification of documents during their term of office. The subdistrict court judge is therefore stricter than the court, which considered only one of the two criminal offenses proven.

In his judgment, the subdistrict court judge took the position that “both the termination letter and the letter justifying the termination each constituted a document and that their content was misleading.

According to the subdistrict court judge, the municipality had already taken the decision to dismiss the employee in November 2015. This misleading information was intended to prevent the dismissal from being linked to a letter from the employee in which he had threatened to report several cases of construction law violations.

At first instance, the Entremont court sentenced the ex-president to a conditional fine of 40 daily rates of 95 francs and the municipal secretary to a conditional fine of 30 daily rates of 230 francs each, each with a suspension of two years. (SDA)
