“All policemen are bastards”: no consequences for the Vaud councilor

For crimes such as slander, slander or insult, the injured party must be identified or identifiable, the Public Prosecution Service writes in a press release on Thursday. However, the slogan ACAB (“All cops are assholes”) referred to “all cops” and not directly to the complainants. “The latter were not injured and the crimes in question cannot be prosecuted,” it says.

Attorney General Eric Kaltenrieder also noted in his refusal that discrimination and incitement to hatred – a crime prosecuted ex officio – could not be considered. The police officers are not included in the list of categories protected by the Penal Code (race, ethnicity, religion and sexual orientation).

The public prosecutor’s office had publicly announced its decision because of the particular scope of this case, which had caused quite a stir outside the canton of Vaud.

In a March Instagram post, which was later deleted, Marendaz posed with a sign denouncing the concrete industry and reading ACAB in smaller letters. The 26-year-old representative of the left-wing party Ensemble à Gauche received a lot of sharp criticism. Two police associations and five active or retired police officers filed complaints.

Marendaz issued an apology and rejected any calls for “hate against police officers as individuals”. Yverdon VD’s MEP explained that she was instead criticizing the attitude of the police and the violence she had engaged in.
