The National Council shows heart: paternity leave also in case of stillbirth

The verdict was clear. With 127 against 57 votes with 6 abstentions, the National Council voted yes to the motion of Green National Councilor Greta Gysin (39). This requires that the two-week paternity leave be granted even if the child is stillborn. Or die in childbirth. This is against the will of the Bundesrat.

Now the Council of States decides.

Federal Council refers to optional rule

In its statement, the state government claimed that the primary purpose of paternity leave was to allow new fathers to become involved in the changed family situation with the newborn.

In the event of a stillbirth, the employer may allow the employee all the necessary time “for special occasions” in accordance with the Swiss Code of Obligations.

Mourning with the mother

However, that was not enough for a majority in the National Council on Tuesday. The Grand Chamber calls for legislation to be amended so that paternity leave must be granted in full – even if the father is not happy with a newborn baby but has to grieve with the mother.

Because the purpose of this holiday is also to support the mother during the postnatal phase, said Gysin from Ticino. This is especially necessary in the tragic case of a stillbirth. (SDA)
