US tech group Apple wants to keep the image of a realistic apple from the Swiss Granny Smith variety as its trademark. Apple demands that the apple image be preserved in all possible colors, a spokesperson for the Swiss Federal Intellectual Property Institute (IGE) told Tamedia.
Last October, IGE partially denied trademark protection for the apple image. The image, according to officials, is an everyday apple. Apple later filed a complaint with the Federal Administrative Court.
The Beatles’ Apple
Apple is the Granny Smith variety. Such fancy records from the Beatles’ recording studio. Apple now wants to protect the real apple as well. It is unclear why they did this. Apple did not answer Tammedia’s questions. However, the tech group invests heavily in brand protection.
If a figurative mark is protected, others cannot mark any protected product. IGE does not elaborate on which goods Apple intends to protect.
Fruit Producers Association has been using apple in its logo for over 100 years. Legal uncertainties could arise if Apple wins. It’s okay to keep using the old signage, but director Jimmy Mariéthoz doesn’t understand the tech band. «The term apple or the image of an apple is common knowledge. They shouldn’t be owned by any company,” he tells Tammedia.
