The Federal Court ruled: Individual modifications to branded products are permitted under certain conditions

The Geneva cantonal court banned Artisans de Genève Switzerland SA from offering Rolex watches and making changes in 2023. In a landmark ruling published on Thursday, the Federal Court concluded that Artisans de Genève’s activities were legal. The company only processes watches brought in by customers and are not intended for resale.

The Federal Court therefore lifted the ban imposed by the lower court. The matter goes to the cantonal judiciary. The case still needs to be examined in terms of unfair competition. The decision of the Federal Court can be transferred to other sectors. For example, it concerns modifications to cars or the redesign of haute couture.
