Stephan Schmidheiny was charged with the willful murder of 392 people in the Eternit bis trial in Novara. The prosecution demanded life imprisonment and the defense sought acquittal.
The court also banned the Swiss entrepreneur from public office for five years and set a temporary amount of over 80 million Euros, of which 50 million Euros alone for the municipality of Casale Monferrato.
The Schmidheiny family managed the Eternit factory in Casale in the Piedmont region from 1976 to 1986.
The criticism came immediately from Schmidheiny’s spokesperson, Lisa Meyerhans. The court in Novara told the Keystone-SDA news agency on Wednesday evening that it “does not fully appreciate the clear evidence of Stephan Schmidheiny’s innocence in its decision”.
The court flatly denied intent, so “most of the alleged acts” were timed. His spokesman, however, said the decision was “clearly illegal” as Stephan Schmidheiny could not be charged with negligence.
The Eternit SEG group, led by Schmidheiny, was the main shareholder of Eternit Italia S.pA from 1973 until it went bankrupt in 1986. Stephan Schmidheiny, who took over the management of Eternit SEG in 1976 at the age of 28, is the younger brother of Thomas Schmidheiny, the main shareholder of Swiss cement manufacturer Lafarge-Holcim.
Stephan Schmidheiny’s lawyers have always argued that their client is not directly responsible for running the company.
