Martin Ogg (55), long-time captain of FC Schaffhausen and cup final and promotion hero, told his story at the Blick at the end of December. At the age of 54, he was diagnosed with Alzheimer’s disease. This was a hard shock to digest. But Ogg is a fighter and wants to make the most of the time he has left.

Ogg met Gabriela Beutler (54) in the summer and did not hide the fact that she had Alzheimer’s disease. Despite their illnesses, the two fell in love with each other, started living together and now want to get married. Gabriela Beutler is lucky for the former football player. She comes from a nursing background and has experience of dealing with people with dementia.

Ogg should show its capacity

The wedding was planned to take place on February 9, 2024. They then need to take a longer trip to Asia, to Thailand and Cambodia; Here the duo wants to look into specialized care centers for dementia patients. It has suddenly become clear whether the wedding will take place or not.

A week ago, the Schaffhausen civil registry office informed Ogg that he must first prove his capacity to prosecute. This process corresponds to ZGB. Article 94 regarding marriage license says: “She can marry two people who are over 18 years of age and have the ability to reason.” Judgment is specifically checked if there is any suspicion that cognitive limitations exist. It’s been known since Ogg’s appearance.

The registrar is assessing the situation

Now two people who want to get married must audition. As part of the mandatory pre-marriage interview where the usual data is checked, Martin Ogg must also answer questions that inform his decision. It should be clear that he knows what he is doing, that he is doing it voluntarily, that he understands the nature of marriage, and that he can evaluate its consequences.

At the end of this interview, the civil registry officer may decide to dismiss in case of doubt. If Ogg’s marriage is actually denied, he can appeal the decision. Other explanations will follow later; for example, health certificates may be evaluated or close contacts may be interviewed.

Flexibility expected from everyone

However, if the registrar gives his approval, the marriage is considered consummated as soon as the two exchange vows. In Ogg’s case it makes sense to do this as quickly as possible. Then no one can object anymore because they are considered to be in a position to make a judgment at the time of the wedding.

Instead of getting married on February 9, the couple’s schedule now looks quite sporty. They have already asked for an opinion from the doctor as a precaution. A meeting, including the “marriage test”, will be held at the end of January, and if everything goes well, the official marriage will be held 75 minutes later. This means that those involved must be very flexible. This applies to those getting married, witnesses, census takers, well-wishers, guests, and most importantly, the catering staff who take care of the planned wedding meal.
