The Supreme Court modified the plan of the Public State Employment Service (SEPE), which withdrew unemployment benefits because it received income from two plants for the production and sale of electricity located on user-owned plots of land in Valencia. In 2016, the woman received more than 12,000 euros in this way, and SEPE considered that these benefits were incompatible with unemployment benefits paid through contributions. However, after a new appeal, the Supreme Court of Justice in Valencia decided that both incomes were compatible. But SEPE trusted the Supreme Court and just settled with the affected person. Since the perception of this economic income is not identified “with the performance of an autonomous professional activity that is not compatible with monetary compensation for the unemployed. The user does not perform work activities for trading companies with which he has concluded contracts on the installation, maintenance and sale of produced electricity, nor any economic activity on a regular, personal and immediate basis. Otherwise, he concluded a contract on the production of photovoltaic energy, without performing any management, maintenance, meter reading, accounting or any other tasks.
