Capac: After the verdict, the right to free movement must be respected

The Panama Chamber of Construction (Capac) stated that the judgment of Supreme Court of Justicedeclaring Act 406 of October 20, 2023 unconstitutional, is final and conclusive and therefore no appeal is allowed against it.

According to Capac, in this way, the causes that fueled the popular protests of a large part of the population are removed.

“We hope that the national government will present to the Panamanian community a proposal or an orderly plan of all the activities, audits and other components necessary to comply with the mine closure process,” the statement added.

Yesterday, the Supreme Court of Justice, by a unanimous decision of the plenary session of the highest judicial body, declared Law 406 unconstitutional.

The judges identified 25 violations of the political constitution of the Republic of Panama.

As a sign of rejection of the mining contract, civil society, union members and various unions demonstrated for more than a month with protests and street closures.

After the verdict, the president Laurentino Cortizo announced that as soon as the official announcement of the verdict from the Supreme Court of Justice will be immediately published in the Official Gazette, the transition procedure for the orderly and safe closure of the mine will begin.
