Sexsomnia case concerns German court: did the prosecutor really abuse his son in his sleep?

What really happened on the night of March 26 to 27, 2019? An extraordinary case is currently being heard at the Lübeck Regional Court. Special and not only because of the suspect, a former public prosecutor (52). The case is also special because the suspect claims to have committed the crime in a deep sleep. This could mean that the 52-year-old was innocent.

The former prosecutor is accused by his own son (8) of sexually abusing him that night. The man claims he cannot remember anything, Der Spiegel reports. He suffers from sexsomnia, a sleep disorder in which the patient has sex while sleepwalking.

Problems at work

The father – still a public prosecutor at the time – was going through a difficult time: the stress at work got to him. The superiors were not satisfied with his work. He was “extremely irritable,” he told the psychiatric expert, and under “extreme tension.” That evening he drank three or four beers, poured himself the rest of a bottle of whiskey and wanted to ‘go away’.

The next morning, the son said his father had woken him up in the middle of the night and abused him, even though he had defended himself. The mother then took the child to the pediatrician, a therapist and the police. The 52-year-old drove to work and later turned himself in.

Ex-partner testified

The father has now taken early retirement as a public prosecutor. He currently has no contact with his son. His wife moved with their three children. She’s divorced.

The former prosecutor does not deny the allegations or downplay them. A former partner of the suspect stated at the hearing that she woke up several times during the relationship because he had sex with her while she slept.

The son’s lawyer views the fact that the 52-year-old suffers from sexsomnia as a protective claim. Rather, he considers a so-called ‘dysfunctional coping strategy’ plausible: that the father wanted to reduce the stress caused by the sexual abuse by exercising power. The verdict is expected on Wednesday. (no)
