German company wanted to stop sales: Nespresso wins in Federal Court in Vertuo capsule dispute

Nespresso won the lawsuit against the German company K-fee System GmbH.

Nespresso was allowed to continue marketing Vertuo coffee capsules. The Federal Court rejected a complaint from a German company. The company was of the opinion that the new Nespresso system infringed Swiss and Liechtenstein patents.

The plaintiff was K-fee System GmbH from Germany. He has three patents related to barcoded coffee capsules. In August 2021, St. Louis filed a petition to ban the production and distribution of Nespresso’s Vertuo capsules from food company Nestlé. He filed a lawsuit with the Federal Patent Court in St. Gallen. He also demanded compensation and destruction of stocks.

K-fee System GmbH believes that the coding system used by Nespresso is protected by its patents. This emerges from a decision published by the Federal Court on Wednesday. Vertuo capsules have machine-readable black or white lines around the edges to optimize settings.

After the Federal Patent Court rejected the case, K-fee appealed to the Federal Court. But this confirmed the lower court’s opinion. The patent court essentially found that the binary code added to the Vertuo capsules was not a barcode within the meaning of the asserted patents.

Therefore, Nespresso was allowed to continue selling Vertuo capsules. Coffee lovers will be happy. (SDA/wgr)
