High Court in China he supported this week dismissal of an employee who spends excessive time in the bathroom during his work day after surgery for anorectal disease.
The case that happened in September 2015 caused a wide discussion on the Asian giant’s social networks about the rules of conduct in the workplace and the consequences of non-compliance.
According to the ruling, Mr. Wang, who signed a permanent contract in April 2013 after working for the company since 2006, underwent surgery for anorectal disease in December 2014.
After recovering in January 2015, the worker started spending 3 to 6 hours a day in the office bathroomciting pain and discomfort.
In view of the continuous absences, the company recorded and documented the employee’s prolonged stay in the bathroom, which is why a warning was issued regarding punishment and dismissal in accordance with the union provisions and regulations established by the company’s rules of procedure.
In response, the employee requested arbitration, in which he demanded the fulfillment of the employment contract and reinstatement, which is a goal he achieved in the first instance. However, the company appealed the arbitration board’s decision and took the case to court, losing employment.
The High Court ruled that in its judgment dismissal is legal and effective, based on “inappropriate” behavior of the employee at the workplace and found that prolonged time in the bathroom exceeded normal physiological needs and violated the rules stated in the employee handbook.
“It is understandable to go to the toilet during working hours, because people have three urgent needs. However, Wang’s approach was a bit over the top“, it was pointed out in the court verdict.
This ruling set an important precedent in the workplace in China and fueled discussions about the responsibilities and obligations of employees in relation to the rules of conduct in the workplace.
The sentence emphasizes the importance of complying with the regulations established by companies to avoid negative consequences, even in cases of open-ended employment contracts.
On the social networks of the Asian country, where the news climbed to the top of the relevance lists, discussions and polls were launched about the expected time of the worker’s visit to the toilet.
