After two trials for his political impeachment and a criminal indictment in which he was never found guilty, a trial begins this week in New York that, despite years of trying to block it, could convict him Donald Trump per rape. E. Jean Carrollwriter and former magazine columnist Elleaccuses the former president of sexually assaulting her in a department store dressing room three decades ago, which the tycoon continues to deny.
It is actually two separate civil lawsuits, one for defamation and one for rape. A last-minute attempt to delay the civil trial again by Trump’s lawyer, Joe Tacopina, who asked for a one-month delay, citing negative publicity caused by the recent indictment in the porn actress trial, failed. Stormy Daniels asked for a “cooling off period” to ensure an impartial jury.
The judge in the case, Lewis Kaplan, rejected the proposal, considering that a month would not change anything, and that damages cannot be sought when some of the publicity was caused by Trump through his media platform, where he attacked the affected person.
The defamation lawsuit was filed by Carroll against the then-president in November 2019, five months after the reporter accused Trump of raping her at the Bergdorf Goodman store in the mid-1990s. As the case dictated, Carroll opted for this legal formula when she Trump accused her of lying to promote her book. He is seeking compensation for “professional, emotional and reputational” damages.
A gift for his wife
Carroll was the first to accuse Trump of sexual assault in his book What will men do to us?, a modest production in which she recounted the various types of abuse she was exposed to. The magazine published a clip with an episode of Trump’s sexual assault New York in June 2019. In it, Carroll recounted that he was shopping at a Bergdorf-Goodman department store in New York when a tycoon approached him and struck up a conversation. Then he asked her for help choosing a gift for his wife. Flattered by the billionaire’s recognition, she was ushered into the store’s lingerie department, where Trump grabbed a see-through item and took her into the dressing room to try it on. He held her there and sexually abused her for three minutes.
According to the lawsuit, Trump pushed her against a wall and forcefully kissed her until she pushed him away. Then he pressed her again, “took off her socks and raped her until she managed to push him away and run away”. Carroll told the episode to one friend immediately, and to another a few days later, something that both Lisa Birnbach and Carol Martin confirmed and will likely testify before a jury.
But the writer did not file a report with the police because “she was in a state juice And she didn’t want to see herself as a rape victim.” Some advice from friends kept her from “taking a very powerful man.”
The complainant now points out that the appearance of the movement #Me too at the end of 2017 is what convinced her to tell her story publicly. When the article was published and pressed by the press at the White House, Trump dismissed the allegations, saying the writer was “not his type.”
