“States have the primary responsibility for removing the obstacles that transgender people face in exercising their human rights,” said Dunja Mijatovic, Commissioner for Human Rights of the Council of Europe.
Despite the increased visibility of transgender people and significant progress, there are “shockingly high rates of discrimination, violence and insecurity that transgender people experience in their daily lives” in Europe, according to a report from the organization, which will be presented on Thursday.
In concrete terms, the Council of Europe recommends that transgender people have access to specific healthcare without having to submit a psychological report. Furthermore, gender identity should be expressly included as a prohibited ground for discrimination in the relevant laws.
According to the Council of Europe, anyone who can credibly demonstrate their fear of persecution as a trans person should be able to be recognized as a refugee. In prisons, depending on the individual case, it must be determined which detention facility is the correct one.
The procedures for legal gender reassignment should therefore be carried out much faster and more transparently and should also be open to minors, provided that their maturity and needs are sufficiently taken into account. According to the recommendations, strict age limits may not apply. Sanitary facilities must be able to be used safely and with dignity by all people. In the best case, there would be a facility available that was inclusive of all genders, the report said.
In Germany, the Bundestag is currently debating whether to make gender data easier. According to the bill by Family Minister Lisa Paus (Greens), everyone should be able to determine their own gender and first name in the future and change them through a simple procedure at the civil registry.
