An Austrian had of course imagined this holiday very differently. Since the water level of the sea in Grado (I) was not as perfect as on the glossy photos on the Internet, the angry tourist went to court. The bizarre accusation: the sea was suddenly gone.
The woman had to run meters after the sea, writes heute.at. In the catalog it looked very different. After her return, the angry Austrian sued her tour operator – and rejected her.
It is known that the ebb and flow in Grado is quite pronounced, a lawyer explained to the news portal. You must therefore take into account that the water level is lower than indicated in the catalogue. That is how the court saw it. Legally there was nothing for the woman to gain – certainly not afterwards.
Vacationers often expected a refund if what they found didn’t meet their expectations. In reality, however, normally only five percent of the price would be reimbursed, the lawyer continues. He advises taking pictures of any actual defects to document the matter. The tour operators must ensure that the images shown actually correspond to reality.
The lawyer explains that the total number of legal processes in the travel industry would decrease: “The legal departments are getting better and amicable agreements are being made”. (A)
