Ahead of the damages lawsuit against vaccine manufacturer Biontech in a German court starting Monday, the German Ministry of Health has announced the number of pending legal actions for damages against vaccine manufacturers: there are more than 200.
“There are currently 209 claims for damages against the manufacturers of Covid-19 vaccines pending before the court,” the ministry told the “Welt am Sonntag”.
The number of lawsuits is also known to the ministry because the Federal Republic of Germany largely bears the costs of the proceedings and any claims for damages for the production companies, the newspaper reports. It is obliged to do so under the contracts with the vaccine manufacturers, which the EU Commission concluded during the corona pandemic.
Lawyers for the potentially vaccine-damaged plaintiffs criticize the state’s takeover of costs as a detriment to plaintiffs. “The state plays a dual role in the Covid-19 trials, which is problematic,” said the attorney who represented the plaintiff in the trial at the Rottweil court against Biontech, the “Welt am Sonntag.”
Lawyers fear that the state’s assumption of costs will affect ongoing compensation proceedings. Because the state pays their lawyers, the manufacturers have no interest in reaching a settlement.
Left-wing health politician Kathrin Vogler, 59, said it was understandable that “in the pandemic situation, the state largely relieved manufacturers of the liability risk of ensuring that vaccines were supplied to the population.”
However, this leaves those affected “faced with a seemingly insurmountable phalanx of lawyers and appraisers pushing them into a David versus Goliath fight on behalf of the companies’ legal departments, but at the expense of taxpayers,” says Vogler. . (SDA)
