Xamax’s demotion lawsuit dismissed by CAS

Xamax is having a miserable sports season. For the CAS, you couldn’t complain about staying in the league.

Neuchâtel Xamax failed to fight for league status in the Challenge League via legal action. The traditional Neuchâtel club failed before the International Court of Arbitration for Sport CAS with its appeal against a decision of the Swiss Football Association SFV regarding the modalities of promotion and relegation in the Promotion League.

The SFV had decided that the third best team in the Promotion League that is eligible for promotion at the end of the season could play the barrage with a second leg against the last team in the Challenge League. Xamax, on the other hand, demanded that it automatically remain in the Challenge League if any of the top 3 in the Promotion League failed to meet the promotion criteria. The legal dispute arose because the Swiss Football League (SFL), which regulates the two professional leagues in Switzerland, and the first league (umbrella organization of the Promotion League and the 1st league) do not have the same regulations, which govern the up and down Relegation to the Challenge League is concerned. SFV must bear the costs of the proceedings

According to the CAS, the SFV must bear part of the legal costs due to the “lack of due diligence on the part of the Swiss football authorities”. Meanwhile, Jean-François Collet, the chairman of Neuchâtel Xamax, announced at the request of the Keystone-SDA news agency that his club could still take the case to federal court. Appropriate considerations would be made.

Neuchâtel Xamax has been in last place in the Challenge League since the first match day. With eight rounds to go, Jeff Saibene’s team is eight and nine points behind Vaduz and Bellinzona respectively. (SDA/dti)
