What exactly is Embolo accused of?

According to the indictment, Breel Embolo was out and about in the Steinenvorstadt district of Basel in the early morning hours of May 27, 2018. The footballer was accompanied by two colleagues, including the second suspect, IK*. At around 5 a.m., the group met with the next two plaintiffs, CA* and DG*. A dispute ensued – the trigger is not mentioned in the indictment. But in the context of this dispute, Embolo allegedly threatened the accuser CA: “I will destroy you. Don’t you know who I am?” and “I’ll kill you!” and “I’ll flatten you!” The indictment said CA was “terrified” by this, Embolo also allegedly threatened the second plaintiff DG: “I’ll have you beat up too, asshole!”

The argument grew more intense. Suddenly, Embolo’s colleague allegedly hit the prosecutor CA in the face with his fist. The injured man was then treated at the University Hospital in Basel. The diagnosis: multiple broken noses. He underwent surgery and was unable to work for two weeks.

What is the fine?

Embolo is currently facing multiple threats in court. The ongoing proceedings are also discussing two criminal convictions – legal verdicts are available – because the alleged crime falls within the three-year probation period.

His friend has to answer for simple bodily injury. In addition, two subsequent offenses are likely to be dealt with: Just a few months later, the colleague allegedly violated the federal narcotics law and prevented an official act.

What threatens Embolo? And what about his friend?

Under the Penal Code, Embolo risks a prison sentence of up to three years or a fine simply because of multiple threats.

Why did Embolo stumble over his criminal record?

As part of the current indictment, two older crimes are now coming to light at Embolo. For example, it concerns the unauthorized implementation of learning journeys eight years ago. Embolo was sentenced to a fine of 2,000 francs and a suspended fine of 10,000 francs with two years’ probation.

During this probationary period, Embolo continued to interfere in traffic. As a result, he was not given a simple traffic fine, but again an order subject to periodic penalty payments. This extended his probationary period by one year. He also had to surrender his driver’s license.

Now these previous convictions could mean that Embolo will be punished more severely in the current trial.

Does Embolo have to appear in person at the trial?

In fact, already. According to the Swiss Code of Criminal Procedure, suspects must be personally present at the hearing if a crime or misdemeanor is being dealt with or if the trial leader orders personal presence. On request, the trial leader can release the defendant from the personal appearance if he gives compelling reasons and his presence is not required.
