You have “grown apart”. With this justification, Zurich cantonal councilor Isabel Garcia (59) announced her switch from the GLP to the FDP last February. Just eleven days after she was elected for another term by the citizens of Zurich.
Garcia’s party change so soon after the election was met with fierce criticism, especially from the left. Voters feel cheated, the so-called climate alliance consisting of SP, Greens, GLP, EVP and the Alternative List (AL) has been cheated. Garcia’s change causes her to lose her narrow majority.
Monday came the last attempt to stop FDP politician Garcia. But the leftist uprising failed. By a vote of 107 to 52 with 11 abstentions, the cantonal council rejected a motion not to confirm Garcia’s election. Even the left camp was not closed to it. Garcia herself walked out of the vote.
The majority of the group spokesmen agreed: the approach of the new FDP leader is not pure. The party change so soon after the elections and only one day after the end of the complaints period is questionable. It leaves a musty aftertaste, says Benno Scherrer (58) of GLP. It’s like leaving your partner on a honeymoon.
In the end, however, legal arguments prevailed. The common people referred to a Federal Supreme Court ruling on a similar case in St. Gallen. In it, the federal judges state that a party change in the period after the elections and for the composition of parliament can be questionable and can lead to a loss of credibility. But it’s not illegal. This also applies to the canton of Zurich.
“Where do we go if we suddenly refuse elected people the election, just because we don’t like their opinion or attitude?” asked SVP parliamentary group leader Martin Prettyr (54) rhetorically. He argued that a voting rights complaint could have been filed to take legal action against Garcia’s party switch. But that didn’t happen.
All that remains for the hateful lawmakers is to initiate a legislative change so that there can be no second Garcia case. Three EDU council members have already submitted a proposal calling on the government council to take action.
But he plays the ball back: it is the subdistrict council itself that has to arrange it.
